Policy
Purpose: 

This policy provides information about the residency appeal process. It does not replace or supersede Kansas statutes and Kansas Board of Regents regulations. Please follow the links provided in this policy for additional information on how residency status is determined.

Policy Statement: 

Resident tuition classification is determined by criteria found in Kansas statutes and Kansas Board of Regents regulations. The specific criteria are made available by the Office of the University Registrar and by following the links provided in the related documents section of this policy.

Initial Classification

The initial resident tuition classification is made by the Office of Admissions for undergraduates and by the Office of Graduate Studies for graduate students. If the student disagrees with the initial classification, the student should contact the Office of the University Registrar before enrolling in classes and submit an application for resident tuition classification. The current semester submission deadlines can be found be on the academic calendar on the website of the Office of the University Registrar. Students are responsible for providing information sufficient to support their applications for resident tuition classification.

Appeal Procedure

If a student’s application for resident tuition classification is denied by the Office of the University Registrar, the student may appeal this decision. Students must submit a written appeal form within 30 calendar days of the denial notification. The Office of the University Registrar will forward written appeals to the residency appeal committee. Payment in full of tuition and fees as originally assessed is required to avoid late payment fees.

Residency Appeal Committee

  1. The committee shall consist of at least three members to act as an appellate body to hear and determine appeals concerning resident tuition classification.
  2. Members of the appeal committee shall be appointed by the chancellor for a term of two years.
  3. The appeal committee shall elect its own chair who shall be eligible to vote in all cases.
  4. Decisions of the committee are made by a majority vote.
  5. The chairperson of the appeal committee will notify the student within one calendar week of the decision.
  6. The decision made by the appeal committee is the final University determination on the matter.

Residency appeal committee meetings are open to the public. Students who wish to attend the residency appeal committee meeting should contact the Tuition and Fees Specialist in the Office of the University Registrar for more information.

The student is responsible for the payment of non-resident rates if the appeal has not been reviewed by the student’s tuition and fees payment deadline. If resident classification is granted after the tuition and fees have been paid, a refund will be generated automatically.

Background: 

The authority to appeal residency is granted by the Kansas Board of Regents. This policy formerly incorporated detailed requirements and procedures that the University of Kansas uses to determine Kansas residency. These requirements can be found by following the links below.

Definitions: 

Resident tuition classification – Student is classified as a resident for tuition purposes

Resident fee privilege – Tuition assessments equal to resident rates when authorized by the Kansas Legislature and the Kansas Board of Regents

K.S.A. (Kansas Statutes Annotated) – Kansas statutes are all laws enacted by the Kansas Legislature. These statutes are published after the closing of the regular session by the Kansas Revisor of Statutes.

K.A.R. – Kansas Administrative Regulations are all regulations filed in the Secretary of State's office and published in the Kansas Administrative Regulations.
